Acceptable Use Policy

What you may not do on Open Gym. This policy is part of our Terms of Service, so breaking it is a breach of contract — not just bad manners.
1. Scope
This policy applies to everyone on Open Gym — Customers, Experts, and visitors — and covers everything you do on the Platform: your listings, your bookings, your reviews, your messages, and your conduct at sessions you attend or run.
It is incorporated into our Terms of Service and forms part of your contract with us. We have written it in plain language because it should be readable, not because it is optional.
2. Nothing unlawful
Do not use Open Gym to do anything illegal. In particular, do not:
- offer or promote any activity that is unlawful where it takes place;
- launder money, evade tax, or process payments for anything other than genuine bookings;
- offer or solicit sexual services of any kind;
- sell, supply, or promote drugs, doping substances, or unlicensed medicines;
- infringe anyone's copyright, trade marks, or other intellectual property;
- breach data protection law, including by misusing participant data you receive.
3. Safety of participants
- Do not run a session you are not competent to run, or one requiring a qualification you do not hold.
- Do not run sessions in a venue that is unsafe or that you do not have permission to use.
- Do not exceed the capacity you advertised, or admit participants below the stated minimum age.
- Do not give medical, physiotherapeutic, or nutritional advice unless you are qualified and licensed to do so, and never present fitness coaching as medical treatment.
- Do not attend or lead a session under the influence of alcohol or drugs, and do not pressure anyone to train through pain or injury.
- Do not photograph or film participants without their clear consent, and never in changing areas.
4. Respect for people
Do not:
- harass, bully, threaten, stalk, or intimidate anyone, on the Platform or at a session;
- discriminate against anyone on grounds of race, ethnicity, nationality, religion, disability, age, sex, gender identity, sexual orientation, body size, or any other protected characteristic;
- engage in unwanted physical contact, or any sexual advance towards a participant;
- post hate speech, or content that incites violence or self-harm;
- publish anyone's personal data — including photos, contact details, or health information — without their consent;
- impersonate another person, an Expert, or Open Gym staff.
5. Honesty & integrity
- Do not misrepresent your identity, qualifications, certifications, experience, or insurance.
- Do not describe a session inaccurately — its content, level, duration, location, or what is included.
- Do not write, buy, trade, or solicit fake reviews, review your own sessions, or offer anything in exchange for a review or for removing one.
- Do not retaliate against someone for leaving an honest review, or pressure them to change it.
- Do not create multiple accounts to evade limits, bans, or per-customer discount caps.
6. Fair use of the marketplace
- Do not take payment outside the Platform for bookings made through it, or move Customers you met on Open Gym off-platform in order to avoid commission.
- Do not resell tickets commercially or at a mark-up. Vouchers are for sharing a place with someone, not for touting.
- Do not book places you have no intention of using, or block capacity to deny it to others.
- Do not abuse the cancellation and refund rules, or make fraudulent chargebacks.
- Do not guess, enumerate, or test voucher codes you were not given.
- Do not use the Platform to advertise unrelated products or services.
7. Content standards
Anything you post must be yours to post, and must not contain:
- sexual content, nudity, or material that sexualises minors in any way;
- graphic violence, or content glorifying self-harm or eating disorders;
- misleading health or body claims — guaranteed weight loss, cures, or medical outcomes;
- malware, phishing links, or spam;
- other people's images or text used without permission.
8. Technical abuse
- Do not scrape, crawl, or bulk-extract data from the Platform, or use it to build a competing dataset.
- Do not attempt to gain unauthorised access to accounts, systems, or data, or bypass authentication or rate limits.
- Do not overload, disrupt, or attack our infrastructure.
- Do not reverse-engineer the Platform or circumvent its technical protections.
Good-faith security research is welcome. Report what you find to legal@opengym.in before disclosing it publicly, and do not access other people's data while testing.
9. Reporting a problem
If something here is being broken — or if you feel unsafe at a session — tell us at support@opengym.in. Include enough detail to identify what you are reporting: a link, a booking reference, a date.
If someone is in immediate danger, call the emergency services (112 in Hungary and across the EU) first. We are not an emergency service and cannot intervene in real time.
10. How we enforce this
We assess reports individually and proportionately. Depending on what we find, we may remove content, hide a review, cancel a session with refunds, restrict features, suspend an account, or terminate access permanently. Serious matters may be reported to the authorities.
We tell you what we decided and why. Where we remove your content or restrict your account, we give you a statement of reasons and a way to contest it, as required by the Digital Services Act (Regulation (EU) 2022/2065). Experts have the additional complaint route in section 13 of the Expert Terms. If we get it wrong, we reverse it.
We may act on our own initiative as well as on reports, and choosing not to act in one case does not waive our right to act in another.
